General Terms of Use

These terms govern the purchase and the use of every NurbsTools plug-in. Each plug-in’s own terms and each edition’s license complete them. Placing an order means accepting them.

  1. 01Purpose

NurbsTools publishes plug-ins for Rhino 3D. These terms apply to every order placed on nurbstools.com, whatever the plug-in. Each plug-in’s own terms complete them, and prevail on what they specify.

  2. 02Publisher

The NurbsTools plug-ins are published by Ethan Lamothe, sole proprietor (entrepreneur individuel, a French micro-enterprise), trading as NurbsTools, [address], reachable at [contact email]. Hereafter “the publisher”.

  3. 03License granted

A purchase grants a personal, non-exclusive and non-transferable license to use the plug-in purchased, with no time limit, for the major version purchased and all of its minor updates. The plug-in remains the property of its publisher: only a right of use is sold.

The rights that belong to each edition of a plug-in are set out in its license, delivered with the order.

  4. 04Certificate and password

The license takes the form of a PDF certificate in the holder’s name. Together with the password chosen at checkout, it is used to download the plug-in and to move to later major versions.

The publisher keeps neither the certificate nor the password. Keeping them safe is the holder’s responsibility, and the holder should keep a backup copy of the certificate. A forgotten password can be reset with a code sent to the email address recorded in the certificate. A lost certificate cannot be recreated by the publisher.

  5. 05Prohibited uses

    • Sharing, lending, reselling or renting out the certificate, its password or the plug-in.
    • Publishing the plug-in or the certificate, even in part.
    • Circumventing, or attempting to circumvent, the certificate check.
    • Decompiling or modifying the plug-in, except where the law allows it.
  6. 06Revocation

A certificate that is shared, published or used in breach of these terms may be revoked: it then no longer allows any download or update. Revocation gives no right to a refund.

  7. 07Updates

Minor updates of the purchased version are included. How later major versions are offered is set by each plug-in’s terms.

  8. 08Price, payment and delivery

Prices are shown in euros, [VAT scheme to be stated: under the French small-business exemption, “VAT not applicable, article 293 B of the French tax code”; otherwise, all taxes included]. Payment is made once and processed by [payment provider].

The plug-in, the certificate and these terms are delivered as soon as the payment goes through, in a folder to download.

  9. 09Right of withdrawal

The plug-ins are digital content delivered immediately. By placing an order, the buyer asks for this immediate delivery and acknowledges that it ends the fourteen-day right of withdrawal.

[The publisher’s refund policy, for example for a defect that keeps the plug-in from working.]

  10. 10Warranty and liability

Each plug-in is provided as is. The publisher works to fix the defects reported to it, but does not guarantee that a plug-in works with every version of Rhino or on every system. To the extent the law allows, its liability is limited to the price paid.

  11. 11Trademarks

Rhino and Rhinoceros are registered trademarks of Robert McNeel & Associates. NurbsTools and its plug-ins, NurbsView among them, are not affiliated with, associated with, authorized by or endorsed by Robert McNeel & Associates, and have no official connection with it.

  12. 12Personal data

How personal data is handled is described in the privacy policy delivered with the order.

  13. 13Governing law

These terms are governed by [the law of the publisher’s country]. In case of a dispute, an amicable solution will be sought before any legal action.

Privacy Policy

NurbsTools keeps no customer database: the data of a license travels with its certificate.

  1. 01What the certificate holds

The first name, the last name, the email address and a hash of the password (scrypt) are written into the certificate, which the holder keeps. The email address and the hash are encrypted there; the server keeps only the key that reads them during a check.

The password itself is never recorded, anywhere.

  2. 02Use of the email address

The email address is used for one thing only: sending a password reset code when the holder asks for one.

  3. 03On the server

To limit repeated attempts, the server keeps the IP addresses of requests in memory for one hour at most. Its technical logs may contain the identifier of a checked certificate [retention period to be specified].

  4. 04Contact form

A message sent through the contact form is forwarded by email to the publisher, with the name and address given, and the photo if one is attached: re-encoded as a plain JPEG, without its metadata (location, camera). A certificate attached to the message is checked by the server and is neither forwarded nor kept: only what it certifies (holder, email, edition, grade, version, date of issue) goes with the message, to give it priority. The site keeps none of it.

  5. 05Cookies

The site sets one cookie, and only if you switch its language: it remembers your choice for a year. It uses no analytics and tracks no one.

  6. 06Payment

Payment is processed by [payment provider], under its own privacy policy.

  7. 07Contact

For any question about your data: [contact email].
